The filing also named Bobcat dealer Berry Companies Inc. of Kansas as a defendant.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But apparently that wasn&#8217;t enough for <\/span><b><a href=\"https:\/\/www.my-equipment.com\/caterpillar\">Caterpillar Construction equipment<\/a>.<\/b><span style=\"font-weight: 400;\"> The May 26 action is a completely new front.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_Caterpillar_Is_Saying_Now\"><\/span><b>What Caterpillar Is Saying Now<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The new Delaware lawsuit and ITC complaint allege that Doosan Bobcat is infringing four <\/span><a href=\"https:\/\/www.my-equipment.com\/caterpillar\"><span style=\"font-weight: 400;\">Caterpillar<\/span><\/a><span style=\"font-weight: 400;\"> patents related to machine control systems, hydraulic performance, fuel efficiency and smooth-drive technology.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">More specifically, Caterpillar points to its intelligent control systems, the sort of technology that prevents engines from stalling, smooths out jerky machine movements and makes engines more fuel-efficient.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The suit claims Bobcat\u2019s TL519, TL723 and TL923 telehandlers, E145 and E165 <\/span><a href=\"https:\/\/www.my-equipment.com\/wheel-excavators\"><span style=\"font-weight: 400;\">excavators<\/span><\/a><span style=\"font-weight: 400;\"> and T86 <\/span><a href=\"https:\/\/www.my-equipment.com\/crawler-loaders\"><span style=\"font-weight: 400;\">compact track loaders<\/span><\/a><span style=\"font-weight: 400;\"> incorporate these Caterpillar technologies without authorization.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the patents in question, a Machine Control System and Method awarded in August 2013, reportedly covers the ECO-Mode and horsepower control features found in Bobcat telehandlers, compact track loaders and skid steers. Caterpillar, for example, cites its 982 XE wheel loader and 255 compact track loader as machines with these innovations at the heart of their performance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cat isn&#8217;t shy about its frustration either. Doosan Bobcat allegedly ran a far-reaching competitive intelligence program, pitting its machines against Cat\u2019s on a public website that has since been taken down, and used that knowledge in product development in ways that crossed legal lines, according to a lawsuit.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Doosan acquired a detailed understanding of Caterpillar\u2019s products and technologies through this extensive competitive intelligence program that Doosan now hides from public view, the lawsuit states.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Caterpillar is seeking a permanent injunction, lost profits, attorney\u2019s fees, and a jury trial.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the ITC, Cat is pushing for a limited exclusion order that would block imports of the disputed Bobcat equipment into the United States entirely.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_This_Case_Means_Beyond_The_Courtroom\"><\/span><b>What This Case Means Beyond The Courtroom<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">At the core of this divide is who really owns the intellectual property behind modern compact equipment technology, and that has real-world implications in the larger market.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These are not minor features; they are fighting over them. Hydraulic drive automation, intelligent engine controls, geofencing safety systems, and lift arm zone management are the types of innovations that determine how a machine performs on a job site and how competitive a product line can be. Both companies have poured a lot of money into these areas, and both are claiming to have gotten there first.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One other thing to mention is that there is a precedent factor. Bobcat\u2019s original complaint specifically cites the Wirtgen v. Caterpillar case, in which a federal jury found that Caterpillar had to pay Wirtgen $12.9 million in damages for road-milling technology patents, plus damages from the judge. Clearly, Bobcat wants the court to see a pattern here. Caterpillar, for its part, seems equally intent on arguing that it\u2019s been the recipient of the same treatment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the used equipment market, a case that leads to import bans or production limits on either side would have real impacts on machine availability and pricing for contractors, dealers, and buyers. Both Caterpillar and Bobcat dominate segments of the compact equipment market, skid steers, compact track loaders, and <\/span><a href=\"https:\/\/www.my-equipment.com\/sold\/track-excavators\"><span style=\"font-weight: 400;\">excavators<\/span><\/a><span style=\"font-weight: 400;\">, so any supply disruption would be felt quickly.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_Is_the_Current_Situation\"><\/span><b>What Is the Current Situation?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">At the moment, both companies are deeply entrenched. Bobcat continues to hold its original claims in multiple jurisdictions.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Caterpillar now has the March counterclaim in Texas and the separate Delaware action. Cases of this size tend to drag on through the legal system, and given the patent cross-claims between federal courts, the ITC and international courts, it\u2019s probably still a while before these disputes will be settled.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Doosan Bobcat has denied Cat\u2019s original counterclaims but has yet to file a formal response to the amended filings.
