Bobcat Takes Legal Action Against Caterpillar For Patent Violation: Industry Insight

What’s happening in the construction and equipment industry is something people are worried about. In such a massive industry, many things can coexist simultaneously. A legal battle has recently come on the board between two industry giants: Bobcat and Caterpillar. 

Both companies are equipment manufacturers and are standing firm in the market. 

The compact equipment technologies are the latest innovations of this time. Bobcat has recently sued Caterpillar in federal and international courts after claiming that the company is violating Bobcat’s patented technologies. 

What was the actual case that went to the court?

The 14 patents that Bobcat obtained between 2016 and 2021 are the main subject of the complaint that was submitted to the U.S. District Court of the Eastern District of Texas. These patents address key performance systems like power prioritization, lift-arm operating zones, automated hydraulic shifting, variable engine speed control, and tracked vehicle designs. Bobcat claims that Caterpillar manufactured some parts outside of the United States before importing them back for sale, in addition to using these technologies without authorization.

One of Caterpillar’s main dealers, Holt Cat, is also named in the lawsuit, which argues that Bobcat has suffered significant losses as a result of the violation. Bobcat is requesting a jury trial, monetary damages, and an order prohibiting future use of the contested technologies in order to safeguard its inventions.

Will Caterpillar equipment sales be impacted?

Bobcat’s claims encompass a wide range of Caterpillar construction equipment lineup, including a variety of mini and mid-size excavators, long-reach versions, forest machines, and both previous and next-generation CTLs and skid steers. Models with Cat Command remote-operation technology are also highlighted, suggesting that wireless control patents are a significant source of contention.

Many well-known Cat machines may be subject to import restrictions or sales limitations until the dispute is settled if the ITC rules in Bobcat’s favor. This would have obvious ramifications for dealerships and equipment purchasers in various regions.

Did the international complaints fuel the battle?

Unfortunately, the claim does not stay only in the United States but also grows to Europe as well. Bobcat has also filed patent suits with the German District Court and the Unified Patent Court. This global involvement has made the battle more intense and may impact the other OEMs. Industry experts say that the issue may take several months to years to get resolved, and in the meantime, the market may take an unexpected turn.

How will this battle impact the equipment industry?

Even though the lawsuit is still in its early phases, it shows how fiercely competitive the market for small equipment has grown. Since both Bobcat and Caterpillar have solid international reputations and strong clientele, any disruption in sales or product availability may have an impact on contractors’, dealers’, and fleet owners’ decisions to buy.

As of right now, Caterpillar has not publicly addressed the accusations, and the industry is closely observing how both parties proceed.
